Ata d\u00ebshohen p\u00ebr veprat: \u201ckeqp\u00ebrdorimi i pozit\u00ebs apo autoritetit zyrtar\u201d nga neni 414 par. 2-1, lidhur me par. 3, n\u00ebpar. 3.1 lidhur me nenin 31 t\u00eb KPRK-s\u00eb, dhe D.N., p\u00ebr shkak t\u00eb dyshimit t\u00eb bazuar mir\u00eb se i nj\u00ebjti ka kryer vepr\u00ebn penale \u201cKeqp\u00ebrdorimi apo mashtrimi n\u00eb prokurim publik\u201d nga neni 415 parag. 3 lidhur me parag. 1 dhe 2 t\u00eb KPRK-s\u00eb.<\/p>\n<p>Sipas aktakuz\u00ebs, me dat\u00eb 04.08.2022 n\u00eb Prizren, t\u00eb akuzuarit n\u00eb cil\u00ebsin\u00eb e personave zyrtar\u00eb, p\u00ebr vler\u00ebsimin e ofertave n\u00eb tenderin \u201cRenovim dhe mir\u00ebmbajtje t\u00eb objekteve t\u00eb Komun\u00ebs s\u00eb Prizrenit\u201d, duke shfryt\u00ebzuar detyr\u00ebn apo autoritetin zyrtar nuk i p\u00ebrmbushin detyrat e tyre zyrtare, duke mund\u00ebsuar p\u00ebrfitim grupit t\u00eb operatorit ekonomik \u201cP.C.G. Sh.P.K.\u201d dhe \u201cA.-T. Sh.P.K.\u201d.<\/p>\n<p><strong>\u00c7ka dyshohet se vepruan t\u00eb dyshuarit p\u00ebr ta d\u00ebmtuar buxhetin e Komun\u00ebs s\u00eb Prizrenit mbi 400 mij\u00eb euro?<\/strong><\/p>\n<p>T\u00eb pandehurit, veprojn\u00eb n\u00eb kund\u00ebrshtim me Ligjin p\u00ebr Prokurorim Publik dhe n\u00eb kund\u00ebrshtim me Rregullat dhe Udh\u00ebzuesin e Prokurimit Publik, n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb i akuzuari Xh.D., n\u00eb cil\u00ebsin\u00eb e kryetarit t\u00eb komisionit vler\u00ebsues, Y.G., dhe Q.K., an\u00ebtar\u00eb t\u00eb komisionit, i rekomandojn\u00eb autoritetit kontraktues Komun\u00ebs s\u00eb Prizrenit, lidhjen e kontrat\u00ebs n\u00eb vler\u00eb 550.000,00 \u20ac, me grupin e operatorit t\u00eb lartp\u00ebrmendur, p\u00ebrkund\u00ebr faktit q\u00eb pes\u00eb operator\u00eb t\u00eb p\u00ebrgjegjsh\u00ebm q\u00eb nuk jan\u00eb rekomanduar nga komisioni vler\u00ebsues, kan\u00eb qen\u00eb m\u00eb t\u00eb lir\u00eb rreth 203.47% p\u00ebrkat\u00ebsisht 202.771.98 \u20ac sipas \u00e7mimeve mesatare t\u00eb realizuar p\u00ebr tet\u00eb situacione deri m\u00eb dat\u00eb 05.08.2024.<\/p>\n<p>Nd\u00ebrsa, i akuzuari S.V., menaxher i kontrat\u00ebs, e akuzuara L.S., mbik\u00ebqyr\u00ebse e brendshme, i akuzuari B.J., mbik\u00ebqyr\u00ebs i jasht\u00ebm, gjat\u00eb ushtrimit t\u00eb p\u00ebrgjegj\u00ebsive t\u00eb tyre nuk kan\u00eb vepruar konform legjislacionit t\u00eb prokurimit, dhe nuk kan\u00eb nd\u00ebrmarr\u00eb asnj\u00eb veprim p\u00ebr t\u00eb parandaluar d\u00ebmin autoritetit kontraktues lidhur me keq menaxhimin e kontrat\u00ebs.<\/p>\n<p>I akuzuari E.Sh., n\u00eb cil\u00ebsin\u00eb e drejtorit t\u00eb administrat\u00ebs \u2013 mbik\u00ebqyr\u00ebs i menaxherit t\u00eb projektit, ka ndikuar q\u00eb operator\u00ebt ekonomik gjat\u00eb faz\u00ebs s\u00eb ofertimit t\u00eb manipulojn\u00eb me \u00e7mime p\u00ebr nj\u00ebsi.<\/p>\n<p>T\u00eb pandehurit e lartcekur, nuk i kan\u00eb p\u00ebrmbushur detyrat e tyre dhe q\u00ebllimisht kan\u00eb mund\u00ebsuar p\u00ebrfitim t\u00eb dobis\u00eb pasurore p\u00ebr grupin e operatorit ekonomik \u201cP.C.G. Sh.P.K.\u201d dhe \u201cA.-T.\u201d Sh.P.K, duke shkaktuar d\u00ebm autoritetit kontraktues \u2013 komun\u00ebs s\u00eb Prizrenit, n\u00eb vler\u00eb prej 412.584,87\u20ac. Me k\u00ebto veprime, t\u00eb nj\u00ebjtit kan\u00eb kryer vepr\u00ebn penale \u201cKeqp\u00ebrdorimi i pozit\u00ebs apo autoritetit zyrtar\u201d sipas KPRK-s\u00eb.<\/p>\n<p>Nd\u00ebrsa, i akuzuari D.N., n\u00eb cil\u00ebsin\u00eb e personit p\u00ebrgjegj\u00ebs t\u00eb kompanis\u00eb \u201cA.T. Sh.P.K.\u201d, Prizren, me vet\u00ebdije shkel rregullat e prokurimit publik, n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb paraqet dokumentacion t\u00eb rrem\u00eb sa i p\u00ebrket \u00e7mimeve t\u00eb para- mas\u00ebs dhe para \u2013 llogaris\u00eb, me \u00e7\u2019rast shumica e pozicioneve kan\u00eb pasur \u00e7mime jo normalisht t\u00eb ul\u00ebta dhe \u00e7mime spekuluese, ku nga 233 pozicione 74 pozicione nuk jan\u00eb realizuar fare dhe q\u00ebllimi i uljes s\u00eb \u00e7mimit n\u00eb disa pozicione shum\u00ebfish n\u00ebn \u00e7mimet e tregut ka qen\u00eb fitimi i tenderit. Me k\u00ebto veprime, i nj\u00ebjti ka kryer vepr\u00ebn penale \u201cKeqp\u00ebrdorimi apo mashtrimi n\u00eb prokurim publik\u201d sipas KPRK-s\u00eb.<\/p>\n<p>Prokurori i \u00e7\u00ebshtjes me rastin e ngritjes s\u00eb aktakuz\u00ebs, i ka propozuar gjykat\u00ebs q\u00eb pas mbajtjes s\u00eb shqyrtimit gjyq\u00ebsor, administrimit t\u00eb provave dhe vler\u00ebsimit t\u00eb tyre, t\u00eb pandehurit e lart\u00ebcekur p\u00ebr veprat penale p\u00ebr t\u00eb cilat akuzohen t\u00eb shpallen fajtor\u00eb dhe t\u00eb d\u00ebnohen sipas ligjit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Prokuroria Themelore n\u00eb Prizren ka ngritur aktakuz\u00eb kund\u00eb 7 t\u00eb pandehur\u00ebve.
